Abstract:
In May, the Council of the European Union approved the EU Artificial Intelligence Act. It is also considering, and likely to endorse, guidelines for the use of AI in EU prisons and probation agencies, set forth in the Committee of Ministers Recommendation on the Ethical and Organization Aspects of the Use of Artificial Intelligence and Related Digital Technologies by Prison and Probation Services. This article examines the AI recommendations and the path Europe is likely to take with respect to the use of artificial intelligence in the management of prisons and probation services. It sets forth a comprehensive range of recommendations for implementing AI across law enforcement, the courts, and corrections, including an assessment of its proper scope and legal and ethical standards.
