Abstract:

This article examines the effectiveness of Ban-the-Box (BTB) policies in promoting fair hiring practices for individuals with criminal records. Although BTB was designed to reduce hiring discrimination by delaying criminal history inquiries, research indicates that it has produced mixed outcomes. Some studies show increased employment opportunities in high-crime areas, particularly within the public sector, while others highlight unintended consequences, such as statistical discrimination against Black and Latino applicants. This article explores these limitations, employer adaptations, and gaps in enforcement that undermine BTB’s intent. The analysis presents policy recommendations based on empirical research, including structured disclosure processes, employer education on implicit bias, enhanced enforcement mechanisms, and record-sealing initiatives. Intended for policymakers, practitioners, and researchers in criminal legal systems and workforce development, this piece provides actionable strategies to ensure that BTB policies achieve their intended goals of fair hiring and reducing recidivism.
