Abstract:
In Vandiver v. Prison Health Services (PHS), 727 F.3d 580, the Sixth Circuit permitted Michigan inmate Vandiver to proceed as a pauper even though he had exhausted his “three strikes” case dismissals under PLRR. The court ruled that a chronic condition that if untreated could culminate in serious injury—in this case the possibility of amputation—could satisfy the “imminent danger”exception under § 1915(g).Keywords: Prison Litigation Reform Act (PLRA); IFP (pauper) status; § 1915(g) exception
