Abstract: 

In deciding the back-to-back appeals in New Jersey v. Scott and New Jersey v. Mathis, 2006 WL 2640221, the Appellate Division of the Superior Court of New Jersey held that the validity of the judicial order authorizing the use of a GPS tracking device would be decided according to the “probable cause” standard. This article summarizes and discusses the details of that case. Also discussed is Commonwealth v. Sloan, 907 A.2d 460 (2006), Pennsylvania; and US v. Minor (Mississippi)
